The resource exists and has been released under an open license that permits free reuse and adaptation. ‘Open license’ is a generic term referring to a specific license or a group of related licenses. For clarity, we use the term ‘Creative Commons licence’ to refer to the most widely used license category. The best way to determine if a resource is OER is to consider the terms and conditions of the license under which the resource is released.
The resource is available under the terms of the open license and has been released in a way that allows others to legally use, adapt and build upon the resource, whether for-profit or not-for-profit. Unlike copyrighted materials, open licenses grant free rights to use and build upon a resource. These licenses are widely used by educators and researchers to make educational resources available and usable for the benefit of all. Although open licenses have been developed by the publishing industry, the concept and purpose of open licenses is firmly rooted in the free sharing of knowledge. It is the openness that is central to the licensing concept. Educators and researchers should expect that their peers and the public will be able to freely use and build upon educational resources that have been released under open licenses. Because of this, a “no rights reserved” or “no known copyright” status on a resource does not necessarily mean that the resource is open for use and adaptation. The right to copy and use a resource under the copyright laws of a country still grants the exclusive rights of the owner of the copyright to that resource. It is the license that creates the open access to use and build upon the resource.
Open Educational Resources (OER) are digital resources made available under an open license that permits their free use and re-purposing by others. OER fulfills the promise of open access to education – allowing learners, teachers, and researchers to exercise freedoms on learning, teaching, and research. When OER are used responsibly, they can have a positive impact on educational access and quality, as well as on the environment and society. However, not all OER are created equal.
